ENDLESS DANCE STUDIO TERMS OF USE Welcome to Endless Dance Studio. Our website www.endlessdance.com.au and its associated domains and apps (“Sites”) are operated by Endless Dance Studio (collectively, “Endless Dance”, “us”, “our” or “we”). Endless Dance delivers various services and functions, including, but not limited to, promoting and selling tickets to our productions, taking bookings for our dance studio, dance program, dance lessons and classes, membership services, promoting and seeking support of donors and supporters, and selling merchandise (“Services”). The Services can be delivered via the Sites or in person at our premises, with the location of our premises being subject to change at Endless Dance’s discretion. By accessing or using our Sites and/or Services, you agree to be legally bound by the following terms and conditions (the “Terms of Use”). Please read these Terms of Use carefully. If you do not agree with any part of these Terms of Use you should refrain from using the Sites and/or Services. We may change, modify, add or delete portions of the Terms of Use from time to time at our sole discretion, and your continued use of the Sites and/or Services constitutes your acceptance of those changes. It is your responsibility to regularly check and/or review these Terms of Use and to decide whether you agree to abide by them and be bound by them. If you do not agree to be bound by or abide by these or any future Terms of Use, please do not use or access (or continue to use or access) the Sites and/or Services. ⸻ 1. Access and Use: 1.1 You must not use the Sites and/or Services, in any manner or for any purpose which is unlawful or contrary to these Terms of Use. 1.2 Endless Dance reserves the right to elect not to provide the Services to you, process any order you place, or allow you access to the Sites, as a result of any conduct that Endless Dance, in its sole discretion, believes may breach the law, infringe these Terms of Use, violate the rights of Endless Dance or third parties, or is otherwise inappropriate for continued access and use of the Sites and/or Services. ⸻ 2. Dance Classes and Workshops: 2.1 Before attending a dance class at Endless Dance, participants must provide Endless Dance with their full name, phone number and email address. Endless Dance may also request your physical address and postcode (optional). If the participant is under eighteen (18) years of age, their date of birth is required. 2.2 By entering an Endless Dance class, you agree and acknowledge the following: a) Dance classes involve a risk of personal injury. Endless Dance takes reasonable care in conducting classes but accepts no responsibility for injury or loss during classes or while participants are at or near the studios; b) You (or your guardian) are responsible for ensuring you are physically and medically fit for the class; c) You must take care of your own safety at all times during the class; d) Entry more than thirty (30) minutes after class start time is prohibited, as participation in warm-up is mandatory; e) Students must not attempt routines beyond their ability level; f) Respectful behaviour is required at all times. Inappropriate behaviour—including but not limited to harassment, discrimination, or intimidation—is prohibited; g) Intoxication or inappropriate behaviour towards any Endless Dance staff, contractor, student or guest may result in removal from the premises without refund. Endless Dance reserves the right to refuse entry at its discretion; h) You (or your guardian) are responsible for your personal belongings. Endless Dance does not accept responsibility for lost, stolen, or damaged property; i) Endless Dance supports transgender, intersex and gender diverse individuals in using restroom facilities aligned with their gender identity. Harassment will not be tolerated. Private accessible facilities are available. 2.3 Class schedules and instructors may vary from week to week. Endless Dance does not guarantee that specific classes or instructors will remain unchanged. 2.4 Tuition fees are due on a [weekly/monthly/yearly] basis and must be paid in advance. 2.5 Tuition fees are non-refundable unless the class is cancelled by Endless Dance. Class packages and discounted items are strictly non-refundable and non-exchangeable. Merchandise may only be exchanged if unused, unworn, and in saleable condition with original sealed packaging. 2.6 Regular attendance is crucial for progress. If you are unable to attend a class, please cancel at least 24 hours in advance. Cancellations within 24 hours are not permitted. Makeup classes may be offered at Endless Dance’s discretion. 2.7 Tickets purchased for “short-courses” and “workshops” are valid only for the dates selected at booking. No refunds or exchanges will be made if you cannot attend. 2.8 The timetable, locations and instructors for all classes and workshops are subject to change without notice. Endless Dance reserves the right to cancel classes. 2.9 Showcase Training Special Terms: • Participants must confirm Showcase Training class times in advance. Schedules may vary each week. • Showcase Training requires a one-time payment. Within 24 hours of the first scheduled class, no refund, reschedule, or credit conversion will be permitted under any circumstances. This applies regardless of personal circumstances or unforeseen events. • If a class is cancelled, fees will be credited back to the membership card used for booking. For direct payments (without a membership card), fees will be refunded to the Endless Dance Credit account. Bank refunds are possible but subject to processing fees, with amounts and processing times varying by bank. • By enrolling, participants confirm they have read and agreed to these Showcase Training Terms. ⸻ 3. Merchandise: 3.1 Endless Dance merchandise may be purchased at the studio or online. 3.2 Online merchandise purchases are subject to the terms and conditions of the relevant e-commerce platform. ⸻ 4. Payment: 4.1 Endless Dance accepts online payments for classes, workshops, short-courses, and packages. 4.2 By purchasing via our Sites or Services, you agree to pay in full at the time of purchase. 4.3 All prices: a) are in Australian dollars unless otherwise stated; b) are fixed once your order is confirmed, subject to payment being made immediately (unless otherwise agreed in writing); c) may change at Endless Dance’s discretion without notice. 4.4 By making a purchase, you warrant that: a) all information provided is accurate and not misleading; b) you are authorised to use the payment method; and c) sufficient funds are available to complete the transaction. ⸻ 5. Personal Information and Privacy: 5.1 Endless Dance’s Privacy Policy forms part of these Terms of Use. 5.2 By using the Sites and/or Services, you consent to Endless Dance retaining and using your personal information in accordance with our Privacy Policy. 5.3 Customers grant permission for Endless Dance to use photographs or videos taken during classes for promotional purposes unless otherwise notified in writing. ⸻ 6. Intellectual Property: 6.1 Endless Dance is the exclusive owner or authorised licensee of all content delivered via the Sites and Services, including choreography, media, design, software, trademarks, and other intellectual property. 6.2 No rights in Endless Dance intellectual property are granted without express written consent. ⸻ 7. Disclaimer: 7.1 Use of the Sites and/or Services is at your own risk. 7.2 To the maximum extent permitted by law, Endless Dance excludes all liability for: a) your use of the Sites and/or Services; b) cancellation, modification, error, or interruption of the Sites and/or Services; c) defects, viruses, hacking, or security breaches; d) reliance on any information from the Sites and/or Services; e) cancellation, injury, loss, or damage relating to any ticket, purchase, performance, or class. ⸻ 8. Liability and Indemnification: 8.1 You agree to indemnify Endless Dance from all losses, costs, and damages arising from: a) your use of the Sites and/or Services; b) your breach of these Terms of Use; c) use of the Sites/Services by you on behalf of another person. 8.2 Where liability cannot be excluded by law, it will be limited to: a) re-supply of the service or payment of the cost of re-supply; or b) replacement, repair, or equivalent supply of goods. 8.3 Endless Dance will not be liable for indirect or consequential losses, including loss of profits, data, goodwill, or opportunity. ⸻ 9. Modification of Sites and Services: Endless Dance may modify, suspend, or discontinue the Sites and/or Services at any time. ⸻ 10.
